Information We Collect
We may collect and process the following data about you:
• Information that you provide us by completing forms on our sites. This includes information provided at the time of registering to use our sites for access to the Ephesoft Partner Portal, subscribing to Ephesoft Newsletters, or requesting access to resources such as whitepapers and webcasts, including contact details such as name, email address and phone number.
• Information that you upload to, or share through, our sites by using our services including profile information or any personal information in data that you upload.
• Information that you provide us by completing surveys on our sites.
• Information you provide to us when contacting us for customer or technical support through Ephesoft Chat, email outreach or by phone.
• Information that you provide us when carrying out transactions through our site including payment details such as credit card information and billing addresses.
• Information you provide to us when you submit questions or comments to us via our sites chat interface.
How We Use Information
Cookies and personal information collected through forms on our sites, or provided with your consent at conventions, trade shows and expositions that Ephesoft participates in are used to improve the quality and user experience our sites and relevant marketing communications as they pertain to expressed interest in Ephesoft products and services.
How We Protect Information
Ephesoft takes reasonable precautions to protect personal information in its possession from loss, misuse and unauthorized access, disclosure, alteration and destruction. We use reasonable, industry-standard precautions, including appropriate technical, administrative, and physical procedures, to protect personal information from loss, misuse, unauthorized access, disclosure, alteration, and destruction. All information you provide to us is stored on secure servers operated by us or our third party providers. For example, payment transactions are encrypted using Secure Socket Layer (SSL) technology to protect logins, credit card numbers and other valuable information. For your protection, we may contact you in the event that we find an issue with a product or service you have purchased that requires your immediate attention.
Where we have given you (or where you have chosen) a password which enables you to access certain parts of our sites, you are responsible for keeping this password confidential. Ephesoft employees do not have access to said password.
Ephesoft may disclose your personal information to any member of our company and its subsidiaries. Ephesoft and its business partners enter into confidentiality agreements which require that care and precautions be taken to prevent loss, misuse, or disclosure of your personal information. We will never share the personal information you provide to us except as described below.
We may disclose your personal information to third parties under the following circumstances:
• As required by law (such as responding to a valid subpoena, warrant, audit, or agency action, or to prevent fraud).
• For research activities, including the production of statistical reports (such aggregated information is used to describe our services to current and prospective partners and other third parties, and is not used to contact the subjects of the report).
• In the context of a business transaction, such as a merger, acquisition, consolidation, or divestiture (pursuant to a pledge of confidentiality under which the recipient agrees to use the information for no purpose other than carrying out the transaction).
Your Choices About Marketing Communications
Ephesoft sites strictly adhere to CAN SPAM Compliance laws and abide by US / EU Safe Harbor Laws. We may send you email about your account, about the products or services you have purchased, to remind you about a webcast for which you have registered, or in response to your questions. We may also send you emails with information and/or special offers about Ephesoft products and services that may be of interest to you, events in your region or webcasts based on related previous engagements, unless you indicate that you do not want to receive them.
Ephesoft email marketing practices are authenticated through the two most commonly accepted standards: Sender Policy Framework (SPF) and DomainKeys Identified Mail (DKIM). You may opt-out of receiving marketing communications at any time by clicking on the opt-out link in the footer of an email you have received. How To Change Or Remove Information
You may change or remove your profile information displayed through our sites at any time by going to your profile and editing your information. However, if you want to change the personal information we hold about you in our systems, you will need email your request to firstname.lastname@example.org.
If you want to stop using your account you may deactivate it. When you deactivate an account, you will not be able to use our service and your information will not be capable of being viewed through our site. However, even after you deactivate your account, copies of your information including but not limited to name and email address may be retained by us as backup copies for legal and compliance reasons.
U.S. – E.U. SAFE HARBOR PROVACY POLICY
The United States Department of Commerce and the European Commission have agreed on a set of data protection principles and frequently asked questions to enable U.S. companies to satisfy the requirement under European Union law that ensures adequate protection for personal information transferred from the EEA to the United States (the “US-EU Safe Harbor”). The EEA also has recognized the U.S.-EU Safe Harbor as providing adequate data protection. Consistent with our commitment to protect personal privacy, Ephesoft adheres to the principles set forth in the U.S. – EU Safe Harbor.
The following definitions shall apply throughout this Policy: “Agent” means any third party that uses personal information provided to Ephesoft to perform tasks on behalf of and under the instructions of Ephesoft. “Ephesoft” means Ephesoft.com, Inc. and each of its predecessors, sub domains, sister sites, successors, and affiliates. “Personal information” means any information or set of information that identifies or could be used by or on behalf of Ephesoft to identify an individual. Personal information does not include information that is encoded, anonymous, aggregated or publicly available information that has not been combined with non-public personal information. “Sensitive personal information” means personal information that reveals race, ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, or that concerns health or sex life. While Ephesoft does not currently collect sensitive personal information, Ephesoft will treat as sensitive personal information any information received from a third party where that third party treats and identifies the information as sensitive.
The privacy principles in this Policy are based on and in accordance with the Safe Harbor Principles. Additional information about the Safe Harbor program is available at the U.S. Department of Commerce’s website at www.export.gov/safeharbor.
When Ephesoft collects personal information directly from individuals in the EU, it will inform them about the purposes for which it collects and uses their personal information, the types of non-agent third parties, if any, to which Ephesoft discloses that information, and the choices and means, if any, that Ephesoft offers individuals for limiting the use and disclosure of their personal information. Notice will be provided in clear and conspicuous language when individuals are first asked to provide personal information to Ephesoft, or as soon as practicable thereafter, and in any event before Ephesoft uses the information for a purpose other than that for which it was originally collected.
If Ephesoft receives personal information from other entities in the EU, it will use such information in accordance with the notices such entities provided and the choices made by the individuals to whom such personal information relates.
Ephesoft will offer individuals the opportunity to choose (opt-out) whether their personal information is (a) to be disclosed to a non-agent third party, or (b) to be used for a purpose other than the purpose for which it was originally collected or subsequently authorized by the individual. Ephesoft will provide individuals with reasonable methods to exercise their choices.
Ephesoft will use personal information only in ways that are compatible with the purposes for which it was collected or subsequently authorized by the individual. Ephesoft will take reasonable steps to ensure that personal information is relevant to its intended use, accurate, complete, and current.
Transfer to Agents
Ephesoft will obtain assurances from its agents that they will safeguard personal information consistently with this Policy. Examples of appropriate assurances that may be provided by agents include: a contract obligating the agent to provide at least the same level of protection as is required by the relevant Safe Harbor Principles, Safe Harbor certification by the agent, or being subject to another European Commission adequacy finding (e.g., companies located in Canada). If Ephesoft has knowledge that an agent is using or disclosing personal information in a manner contrary to this Policy, Ephesoft will take reasonable steps to prevent or stop the use or disclosure.
Access and Corrections
Upon request, Ephesoft will grant individuals reasonable access to personal information that it holds about them, and Ephesoft will take reasonable steps to permit individuals to correct, amend, or delete information that is demonstrated to be inaccurate or incomplete.
Ephesoft will take reasonable precautions to protect personal information in its possession from loss, misuse and unauthorized access, disclosure, alteration and destruction. We use reasonable, industry-standard precautions, including appropriate technical, administrative, and physical procedures, to protect personal information from loss, misuse, unauthorized access, disclosure, alteration, and destruction.
Any questions or concerns regarding the use or disclosure of personal information should be directed to Ephesoft Headquarters at the address given below. Ephesoft will investigate and attempt to resolve complaints and disputes regarding use and disclosure of personal information in accordance with the principles contained in this Policy. For complaints that cannot be resolved between Ephesoft and the complainant, Ephesoft has agreed to participate in the dispute resolution procedures of the panel established by the European Data Protection Authorities (DPAs) to resolve disputes pursuant to the Safe Harbor Principles.

Adherence by Ephesoft to these Safe Harbor Principles may be limited (a) to the extent required to respond to a legal or ethical obligation; (b) to the extent necessary to meet national security, public interest or law enforcement obligations; and (c) to the extent expressly permitted by an applicable law, rule or regulation.
This Policy may be amended from time to time, consistent with the requirements of the Safe Harbor Principles. Ephesoft will provide appropriate public notice on its website whenever this notice is changed in a material way.
